The District Consumer Disputes Redressal Commission has ordered to pay Rs 5 lakh of Kisan Accident Insurance, Rs 1,000 fine per week, Rs 5,000 for litigation expenses and Rs 10,000 for mental agony to the family of the woman who died due to electric shock. Oriental Insurance Company will have to pay this amount with 9 percent interest within 30 days.
The commission has given this order on the appeal of Kunwar Pal, resident of Alampur Kudaiya of Chandausi tehsil of Sambhal. Kunwar Pal had said in the petition filed in the District Consumer Commission that his mother Javitri Devi died due to electric shock on 21 July 2017. She was a farmer and head of the family. Rs 5 lakh should be paid under Kisan Accident Insurance. He had made this claim to Oriental Insurance Company through DM Sambhal.
The insurance company rejected the claim on 4 December 2017 arguing that no one was financially dependent on the deceased, she was not the head of the family and bread earner. Kunwar Pal filed a petition in the Consumer Commission against this. Apart from the insurance company, Director General of Institutional Finance Department and DM Sambhal were also made parties.
After the hearing, Consumer Commission II Chairman Amarjeet Tripathi and member Pratibha Singh ordered the insurance company to make the payment on 21 April 2025. Their argument that the deceased was not the head of the family and bread earner was rejected. The commission rejected the argument of jurisdiction of hearing and said that if the insurance company’s office is in Lucknow then it has jurisdiction.
